Attorneys for Hugo Chavez announced they are filing a lawsuit on behalf of FARC claiming the three Americans were guilt of interfering with Columbia internal affairs by looking for drug dealers. It was violations of FARC’s human rights for the Colombia military to pretend they were rebels to rescue the hostages. A spokesperson for Chavez said the attorneys will seek a writ of habeas corpus requiring the American government to return the three Americans to the rebels. She said the attorney will take the case all the way to the United States Supreme Court, which she predicted will take the case and by a 5-4 vote (Justices Kennedy, Stevens, Breyer, Ginsburg and Souter for the majority with Justices Scalia, Alito, Thomas and Chief Justice Roberts dissenting), agree with the ACLU, and hold the hostages must be returned to their captors. Also, the Court majority will hold the rebels may recover damages for emotional distress caused by their embarrassment.
